Yes, there are exemptions to WPS requirements even
if the pesticide's label contains WPS statements. One
such exemption would be if the labeling contains non-
agricultural uses such as right-of-ways, etc. WPS also
does not cover workers who are working in areas where
pesticides are directly injected into agricultural plants.
However, in this situation, those people handling injected
materials are covered by WPS as handlers. Other
exempted uses include applications to pasture and
rangeland; uses for the control of vertebrate pests;
materials used as trap attractants or repellents; materials
used for mosquito abatement, Med fly eradication or

similar government-sponsored wide-area applications;
livestock or animal applications; applications in or around
animal premises; postharvest applications; applications in
parks, ornamental gardens, private grounds, and golf
courses, etc., that are intended for decorative or
environmental benefit; and research uses of unregistered
pesticides.
Owners of agricultural establishments and their
immediate family members are exempt from most WPS
requirements. Immediate family members only include
spouses, children, stepchildren, foster children, parents,
foster parents, brothers and sisters of the owner. If only
immediate family members are employed by the
agricultural establishment, it does not have to provide
pesticide safety training, decontamination sites, central
information posting, emergency assistance requirements,
notifications of applications and handler monitoring.

Check pesticide handlers either visually or by voice

communication once every 2 hours.
Maintain constant visual or voice contact with any handler

applying or handling materials in the greenhouse.
Persons entering the greenhouse during fumigation to

operate ventilation equipment, adjust tarps, or check air

concentrations must also be monitored as above. These

persons must also be trained as a pesticide handler and

have immediate access to any PPE required by

fumigant's labeling.
